International Exchange Additional Disclosures
By applying for an account, accessing your account, or engaging in any services available to eligible international users, including trading with margin and/or in derivatives, you acknowledge and accept the risks of using these services and the below disclosures. These disclosures shall serve as an addendum to any other applicable user/product agreements and disclosures.
- User Eligibility Disclosure.
Figure Markets offers certain non-U.S. users access to trading on Figure Markets’s international exchange, and other services, including margin trading and derivatives trading, subject to certain geographical and eligibility limitations.
Margin trading and derivatives trading on our international exchange are available to most users that reside outside of the United States. Users located in certain restricted jurisdictions, including Panama, are not permitted to access Figure Markets’s services.
- Risk Disclosure.
Market Risk: Investing or trading in cryptocurrencies or digital assets entails significant risk and may not be suitable for all users. The value of cryptocurrencies can be highly volatile and subject to rapid and unpredictable fluctuations due to factors such as market demand, regulatory changes, technological developments, and market sentiment. Past performance does not guarantee future results. Users should only invest funds they can afford to lose.
Regulatory Risk: Cryptocurrency regulations differ widely across jurisdictions and are subject to frequent changes. Regulatory changes can adversely impact the use, transfer, exchange, and value of cryptocurrencies. Users are responsible for understanding and complying with the regulations in their respective countries. We do not provide legal advice regarding the legality of cryptocurrency use in any jurisdiction.
Cross-Border Risk: Operating across multiple jurisdictions exposes users to additional risks related to cross-border transactions, including potential delays in processing, varying transaction fees, and differences in regulatory requirements. Users should be aware of the legal implications of engaging in cross-border cryptocurrency transactions and ensure compliance with local laws.
Technology Risk: Our platform is subject to cybersecurity risks, including hacking, phishing, and other fraudulent activities. Despite employing advanced security measures such as encryption, multi-factor authentication, and regular security audits, we cannot guarantee absolute protection against breaches. Users should take personal security measures seriously, such as using strong passwords and being cautious of phishing attempts.
Liquidity Risk: Certain assets may have low trading volumes, which may result in significant price volatility and difficulty in buying or selling these assets at favorable prices. Illiquid markets can lead to substantial losses and delays in executing trades. Users should consider the liquidity of the cryptocurrency before trading.
Operational Risk: Operational risks include system outages, technical failures, and human errors, which can impact your ability to trade, deposit, or withdraw funds. - Regulatory Compliance Disclosure.
AML/KYC Compliance: To comply with international regulatory standards, we implement Know Your Customer (“KYC”) and Anti-Money Laundering (“AML”) policies. Users are required to complete identity verification by providing valid identification documents, proof of address, and other necessary information. Failure to complete AML/KYC procedures may result in limitations on account activities, including deposits, withdrawals, and trading or result in the suspension/termination of your account.

Compliance with Local Laws: Users are solely responsible for complying with all applicable laws and regulations related to digital asset trading, and margin and derivative trading in their respective jurisdictions.
Tax Compliance: Users are solely responsible for understanding and fulfilling their tax obligations related to cryptocurrency transactions in their respective jurisdictions. While we may provide transaction summaries and reports to assist with tax reporting, it is the user's responsibility to report and pay any applicable taxes. Users should consult with a tax advisor for specific guidance regarding their tax obligations.
- Operational Disclosure.
Service Availability: We strive to maintain continuous availability of our platform. However, scheduled maintenance and unexpected outages may occur. We will provide advance notice for planned maintenance whenever possible. In the event of an unscheduled outage, we will work diligently to restore services and minimize disruption. Users should be aware that service availability may vary across jurisdictions due to local regulations and operational considerations.
Transaction Fees: Fees are applied to various transactions on our platform, including trading, deposits, and withdrawals, and fees for international users may be different from fees charged to U.S. users. Our fee structure is transparent and subject to change. Current fees are displayed on our website. Users should review and understand the applicable fees before engaging in any transactions.
Customer Support: Customer support is available during U.S. east coast hours of regular business operations. Users can contact support via email or phone. We aim to resolve issues promptly and transparently. Response times may vary depending on the nature and complexity of the inquiry. Users in different time zones may experience varying support availability.

Users should be aware that certain jurisdictions may not allow the exclusion or limitation of liability for certain damages, and in such cases, our liability will be limited to the maximum extent permitted by law.
If you have a dispute with one or more users of Figure Markets’s international exchange, you agree that neither we nor our affiliates or service providers, nor any of our respective officers, directors, agents, joint venturers, employees and representatives, will be liable for any claims, demands and damages (actual and consequential, direct or indirect) of any kind or nature arising out of or in any way connected with such disputes.
You agree to indemnify us, our affiliates and service providers, and each of our, or their, respective officers, directors, agents, employees and representatives, in respect of any costs (including attorneys' fees and any fines, fees or penalties imposed by any regulatory authority) that have been reasonably incurred in connection with any claims, demands or damages arising out of or related to your breach and/or our enforcement of any applicable agreements, including without limitation your breach of our prohibited use policies or your violation of any law, rule or regulation, or the rights of any third party.
